Marshal Hays was shot and killed by Paine Sly while attempting to arrest Sly for creating a disturbance at his home. Marshal Hays was shot in the neck and returned fire before he died, striking Sly in the hand. Sly was sent to the Idaho State Penitentiary to serve life doing hard labor.
